Terms of Use

These Terms of Use (“Terms”) govern your access to the Site and any inquiries, estimates/quotes, and services (collectively, the “Services”) you request via the Site, phone/text, email, or third-party intake forms. By using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

 

1) Eligibility Requirements

 

1.1 Minimum Age & Capacity. You must be 18+ (or the age of majority where you live) and able to enter a binding contract.
1.2 Entities & Authority. If you act for a business, HOA, landlord, or other entity, you represent you are authorized to bind that entity; “you” includes both the entity and the individual.
1.3 Geographic Scope. We operate from Liberty, KY and primarily serve Kentucky and surrounding Southeast regions. Users outside the U.S. access the Site at their own initiative and are responsible for local compliance. Tip Top Contracting, LLC
1.4 Users Prohibited by Law. Do not use the Site/Services where prohibited (including applicable sanctions/export restrictions).

 

2) Acceptable & Prohibited Uses

 

2.1 Permitted Use. A limited, revocable, non-exclusive license to access the Site for its intended purposes: learn about services, request estimates, communicate with us, and engage the Services.
2.2 Prohibited Activities. You agree not to: (a) violate laws; (b) upload malware or attempt unauthorized access; (c) interfere with or overload the Site; (d) misrepresent your identity or submit false inquiries; (e) spam or harvest data; (f) copy, scrape, republish, or resell Site content without written consent.
2.3 Monitoring & Enforcement. We may monitor, restrict, or suspend access and remove content for violations.

 

3) Accounts (If Enabled)

 

If the Site provides logins/portals, you must maintain accurate info, safeguard credentials, and notify us of unauthorized use. We may suspend/terminate accounts for violations, non-payment, or security risks.

 

4) Inquiries, Estimates/Quotes, Work Orders & Changes

 

4.1 Requests. Requests may be made via the Site, by phone, email, or third-party forms.
4.2 Estimate Basis & Validity. Estimates are based on information available at issuance and are not final pricing. Unless stated otherwise, estimates are valid for 30 days and subject to materials availability and market pricing.
4.3 Site Visit & Hidden Conditions. Pricing may change after inspection or discovery of concealed/non-code conditions (e.g., damaged conductors, hidden junctions, asbestos/lead, structural or trenching obstacles). These require change orders with revised scope/pricing/timeline.
4.4 Authorization to Proceed. Work starts only after written approval (e.g., signed estimate, email confirmation, acceptance via our form/CRM) and receipt of any required deposit.
4.5 Pricing Method. Services may be priced Time & Materials (T&M) or fixed price as indicated on your estimate.
4.6 Allowances/Substitutions. Allowances are reconciled to actuals. Equivalent substitutions may be used if items are unavailable (material substitutions require customer approval where material).
4.7 Change Orders. Customer-requested changes or code-required changes will be documented and approved (email sufficient) before proceeding and are billable in addition to original scope.

 

5) Scheduling, Access & Site Conditions

 

5.1 Access. Provide safe, reasonable access to panels, equipment, and work areas; ensure parking/loading; secure pets/valuables; identify restricted areas.
5.2 No-Access & Wait Time. If our crew cannot access the site or is unreasonably delayed due to your actions/omissions, we may charge a trip fee or standby/wait fee as stated on your estimate/invoice.
5.3 Utility Locates. For trenching/excavation, we or you (as specified) will request utility locates. You must disclose private lines or obstacles not covered by public locate services.
5.4 Safety & Work Stoppage. We may pause/refuse work if conditions are unsafe (live hazards, structural instability, hazardous materials, severe weather) until remediation occurs.
5.5 Emergency Service. We advertise 24/7 emergency availability. Response times vary by location and conditions; availability and specific response times are not guaranteed. Facebook

 

6) Permits, Inspections & Code Compliance

 

6.1 Responsibility. Unless your estimate states otherwise, you are responsible for obtaining/paying for permits and inspections. Where we obtain permits, fees will be billed to you.
6.2 Code Scope. Our work meets applicable codes for the authorized scope. We are not responsible for pre-existing non-code conditions outside our scope. Required code upgrades will be quoted as change orders.

 

7) Materials, Equipment, Title & Risk

 

7.1 Title. Materials/equipment supplied by us may remain our property until paid in full.
7.2 Risk of Loss. Customer-supplied items remain at your risk. We do not warrant customer-supplied materials/equipment.
7.3 Storage & Staging. You authorize reasonable staging/storage and will provide a dry, secure area when feasible.

 

8) Warranties (Workmanship & Manufacturer)

 

8.1 Workmanship. Any workmanship warranty will be expressly stated on your estimate or invoice (if any). If none is stated, Services are provided “as is” to the fullest extent permitted by law.
8.2 Manufacturer Warranties. Manufacturer warranties (if any) apply per the manufacturer’s terms; we do not independently warrant third-party products.
8.3 Exclusions. Warranties exclude misuse, alterations by others, lack of maintenance, normal wear, surges/lightning, or conditions beyond our control.

 

9) Service Fees, Billing & Payment

 

9.1 Pricing & Taxes. Prices are in USD and exclude taxes/fees unless stated otherwise.
9.2 Deposits & Progress. Deposits may be required; larger projects may be invoiced at milestones or regular intervals.
9.3 Overtime/Emergency Rates. After-hours/weekend/holiday/emergency calls may carry premium rates disclosed on your estimate or at dispatch.
9.4 Trip/Cancellation/Restocking. Same-day cancellations, no-access visits, or special-order returns may incur fees as stated on your estimate/invoice.
9.5 Payment Due. Payment is due as stated on your estimate/invoice. We may accept card, ACH, check, or other methods; disclosed processing fees may apply where permitted by law.
9.6 Late Amounts. Overdue balances may accrue interest/late fees as permitted by law. You agree to reasonable costs of collection (including attorneys’ fees) where allowed.
9.7 Billing Disputes. Notify us in writing within 30 days of any charge you dispute; we will investigate and correct if warranted.

 

10) Your Responsibilities

 

Provide accurate information about site conditions/requirements; obtain permissions (landlord/HOA/tenants); move furnishings/contents to create clear work areas; safeguard pets/children; follow post-installation instructions and maintenance; promptly report issues.

 

11) User Content & Submission Policies

 

11.1 Submissions. If you submit text, images, reviews, testimonials, jobsite photos, or messages (“User Content”), you represent you own/have rights and that your content does not violate others’ rights/laws.
11.2 Limited License. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, modify, publish, display, and distribute your User Content to operate, document, and promote our Services (e.g., proposals, portfolio, social posts). You may revoke future promotional use by written notice; prior uses remain valid.
11.3 Removal. We may remove/disable User Content that appears to violate these Terms or is harmful.
11.4 Feedback. Ideas/suggestions may be used without obligation or compensation.

 

12) Privacy & Communications Consent

 

12.1 Privacy Policy. Our Privacy Policy (separate document) explains how we collect, use, share, and protect information and is incorporated by reference.
12.2 Calls/Text/Email. By submitting your contact info, you consent to receive service-related communications (including calls or texts) about estimates, scheduling, updates, and follow-ups. Msg & data rates may apply. You can opt out of marketing texts by replying STOP and get help via HELP; unsubscribe from marketing emails via the link provided.
12.3 Third-Party Tools. We may use third-party form and messaging providers; your use of those tools is subject to each provider’s terms and privacy practices.

 

13) Third-Party Links & Services

 

We may reference or link to third-party sites, maps, analytics, payment processors, or form providers. We do not control or endorse third-party content and are not responsible for their practices or availability. Your use is at your own risk and governed by the third party’s terms.

 

14) Intellectual Property

 

All Site content/materials (text, graphics, layout, logos, photos, look-and-feel) are owned by or licensed to TTC Electrical and protected by IP laws. Except for the limited license in §2.1, no rights are granted. You may not copy, distribute, create derivatives from, reverse engineer, or exploit the Site or its content without our written consent. All trademarks are the property of their respective owners.

 

15) Copyright/Trademark Concerns (Takedown)

 

If you believe Site material infringes your rights, send a written notice identifying the work/mark, the URL of the material, your contact info, and a good-faith statement that the use is unauthorized. Upon valid notice, we will investigate and, if appropriate, remove/disable the material.

 

16) Jobsite Safety, Property, & Indemnification

 

16.1 Safety. We perform work with reasonable care and to applicable standards for the authorized scope. We may stop work until hazards are addressed.
16.2 Property. Certain work (opening walls/ceilings, drilling, trenching) may generate dust/debris or require patching beyond our contracted scope. Finishing/painting/landscaping restoration is included only if expressly stated in your estimate.
16.3 Indemnification. You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from (i) your misuse of the Site; (ii) your breach of these Terms; (iii) unsafe, undisclosed, or non-code conditions outside our control; or (iv) your failure to secure required permissions.

 

17) Insurance & Subcontractors

 

We may use qualified subcontractors. Upon reasonable request, we can provide evidence of applicable insurance, subject to availability and lead time.

 

18) Disclaimers

 

Except as expressly stated in a written warranty:

  • The Site and content are provided “as is” and “as available.”

  • We disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.

  • We do not guarantee uninterrupted Site access, error-free content, or specific outcomes (e.g., energy savings beyond manufacturer specs).

19) Limitation of Liability

 

To the maximum extent permitted by law, TTC Electrical (and its owners, employees, and subcontractors) shall not be liable for indirect, incidental, special, consequential, or punitive damages; lost profits; loss of use; or loss of data. Our aggregate liability related to any claim shall not exceed the amount you paid us for the specific work giving rise to the claim. Some jurisdictions do not allow certain limitations; those apply only as permitted by law.

 

20) Force Majeure

We are not responsible for delays or non-performance caused by events beyond our reasonable control (e.g., severe weather, natural disasters, supply-chain disruptions, epidemics, labor shortages/disputes, war/terrorism, utility outages, governmental actions).

 

21) Mobile Messaging (A2P) Program Terms (TCPA/CTIA-Aligned)

 

21.1 Program Description. With your consent, TTC Electrical may send recurring SMS/MMS messages about scheduling, estimates, service updates, and—if you opt in—marketing/promotional messages. Message frequency varies.
21.2 Opt-In. You may opt in by submitting a form that expressly states you agree to receive texts from TTC Electrical at the number you provide, or by texting a designated keyword to our long code. Consent is not a condition of purchase.
21.3 Opt-Out. Text STOP to cancel at any time. You may also request opt-out via our Contact page; we will process promptly.
21.4 Help. Text HELP for assistance or contact us via the Contact page or phone.
21.5 Costs & Carriers. Msg & data rates may apply. Supported carriers may change. Carriers are not liable for delayed or undelivered messages.
21.6 Privacy. We handle personal data per our Privacy Policy, which explains categories of data collected, purposes, and sharing.
21.7 Recordkeeping. We maintain reasonable records of your opt-in/opt-out preferences (including timestamp/source).
21.8 Eligibility. Must be 18+ and the owner/authorized user of the mobile number provided.
21.9 Content Standards. No harmful, illegal, or inappropriate content. We may suspend messaging for suspected abuse.
21.10 Changes. We may modify or discontinue the messaging program; material changes will be announced via the Site or message.

22) Binding Arbitration; Class Action & Jury Trial Waiver

 

Read this section carefully—it affects your rights.


22.1 Scope. Except for the exclusions in §22.4, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services will be resolved by binding arbitration on an individual basis.
22.2 Rules & Forum. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Unless we agree otherwise, hearings will occur in Casey County, Kentucky, or by video/teleconference at the arbitrator’s discretion. The arbitrator may award any relief available in court (including injunctive relief and attorneys’ fees when authorized by law).
22.3 Fees. AAA consumer filing/admin fees apply. If the arbitrator finds your claim non-frivolous, we will reimburse filing fees that exceed what you would pay to file in state court in Casey County, KY.
22.4 Carve-Outs. Either party may (a) bring an individual action in small-claims court within Kentucky if eligible; and (b) seek injunctive or equitable relief in court for alleged misuse of IP or unauthorized access to the Site.
22.5 Class Action & Jury Waiver. You and TTC Electrical waive any right to a jury trial and to participate in a class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims without both parties’ consent.
22.6 30-Day Opt-Out. You may opt out of arbitration within 30 days after first accepting these Terms by mailing a written notice to: TTC Electrical, Attn: Arbitration Opt-Out, P.O. Box 707, Liberty, KY 42539 (include your name, address, phone, and a clear statement that you opt out). Your timely opt-out means disputes will be resolved in court subject to §23. 22.7 Severability. If any part of this §22 is found unenforceable, the remainder remains in effect; if the class waiver (§22.5) is found unenforceable, all of §22 is void and disputes will proceed in court subject to §23.

 

23) Governing Law; Venue; Time to Bring Claims

 

These Terms are governed by Kentucky law (without regard to conflicts rules). Subject to §22, you consent to exclusive jurisdiction and venue in state or federal courts in Kentucky. Any claim must be filed within one (1) year after it arises (unless a longer period is non-waivable under applicable law).

 

24) Changes to the Site or Terms

 

We may update the Site or these Terms at any time. Updates are effective upon posting with a revised “Effective Date.” Continued use after updates signifies acceptance.

 

25) Miscellaneous

 

Entire Agreement. These Terms (plus the Privacy Policy and any written estimate/contract) are the entire agreement for Site use and Services.
Severability. If any provision is unenforceable, the remainder remains in effect (modified to the minimum extent necessary).
No Waiver. Failure to enforce a right is not a waiver.
Assignment. You may not assign without our consent; we may assign to an affiliate or successor (merger, reorg, asset transfer).
Headings. For convenience only.
Survival. Provisions that by nature should survive (IP, warranties, disclaimers, limitations, indemnification, governing law, arbitration, class waiver) survive termination.
